Payments, Refunds and Chargebacks Policy

This Payments, Refunds and Chargebacks Policy ("Policy") governs the conditions applicable to all transactions carried out on Myclose.fan ("Platform").

Applies to:

• content subscriptions;
• one-time digital content purchases;
• marketplace (physical and digital products);
• ticket and event sales;
• live streams;
• paid interactions between users.

This Policy is an integral part of the Terms and Conditions of Use and should be read together with the Privacy Policy and the Cookies and Technologies Policy.

The Platform acts as a technological and financial intermediary, facilitating payments between purchasing/subscribing users ("Users") and creators, sellers, or organizers ("Creators").

The Platform is not the provider of the content, product, event, or service, does not participate in the material relationship between User and Creator, and does not guarantee results, expectations, or subjective satisfaction.

Each Creator is fully responsible for:

• offer description;
• content, product, or event delivered;
• deadlines, quality, and execution;
• after-sales support;
• compliance with applicable legislation.

The Platform provides electronic payment methods, which may include credit/debit cards, instant transfers, crypto assets, or other authorized methods.

The specific conditions of each method (confirmation deadline, settlement, availability) may vary according to:

• type of transaction;
• user profile;
• security and anti-fraud rules.

Access to the content, product, event, or live stream occurs only after payment confirmation, according to the method used.

Once confirmed:

• the User receives immediate access or as per the nature of the offer;
• the execution of the digital service is considered initiated.

5.1 Digital content, subscriptions, interactions, and live streams

Given the digital nature, immediate access, and instant consumption:

• there is no right of withdrawal after payment confirmation, in accordance with applicable legislation;
• mere access, viewing, or availability of the content constitutes service execution.

Subjective dissatisfaction with the content does not constitute grounds for a refund.

5.2 Marketplace - physical and digital products

For physical products:

• the Creator is responsible for delivery, logistics, warranty, and any returns, in accordance with applicable legislation;
• the Platform may mediate communications without assuming responsibility for delivery.

For digital products:

• the same logic as digital content applies: immediate access precludes the right of withdrawal, except for legal exceptions.

5.3 Events and tickets

For events and tickets:

• the Creator/organizer is responsible for execution;
• the ticket purchase only guarantees the right of access, according to disclosed conditions;
• cancellations, changes, or rescheduling are the sole responsibility of the organizer.

6.1 Good-faith refunds

May be analyzed exclusively when:

• objective breach of the offer is proven;
• a technical failure attributable to the Platform makes access unfeasible;
• proven fraud.

Each request will be analyzed individually.

6.2 Undue or bad-faith refunds

Requesting refunds or chargebacks is expressly prohibited:

• after content consumption;
• due to subjective regret;
• with false or inconsistent claims.

Identification of bad faith may result in:

• refund denial;
• account suspension or termination;
• withholding of funds;
• adoption of legal measures.

7.1 Concept

A chargeback is a dispute filed directly by the User with the financial institution, without the Platform's mediation.

7.2 Express authorization by the User

By accepting this Policy, the User acknowledges and agrees that the Platform may:

• record technical evidence;
• share strictly necessary data with financial institutions, acquirers, card networks, and authorities;
• use such data in defense during disputes, refunds, and chargebacks.

7.3 Evidence used

The following may be used, among others:

• access and authentication logs;
• IP addresses and device identification;
• date, time, and approximate location of access;
• content consumption, live stream, event, and interaction records;
• delivery, access, or check-in confirmation;
• records of acceptance of the Terms and Policies;
• identity and age verification data (KYC).

These records are mandatory and cannot be disabled.

7.4 Consequences of chargebacks

In case of a chargeback:

• the amount may be automatically debited or offset from the Creator's balance;
• the Platform may withhold future funds;
• features may be suspended;
• the User's account may be terminated.

The Platform may withhold, offset, or reserve funds when:

• there are indications of fraud, abuse, or violation of the Terms;
• there is an ongoing chargeback, dispute, or investigation;
• it is necessary to comply with a legal obligation;
• there is financial or reputational risk to the Platform.

Withholding may occur before or after the transfer, until the analysis is concluded.

The Creator acknowledges that:

• they are fully responsible for their offer;
• they must provide documents, evidence, and clarifications when requested;
• they authorize the offsetting of funds to cover the Platform's losses.

Lack of cooperation may result in:

• permanent withholding of funds;
• account suspension or termination.

The following are considered fraudulent practices, among others:

• purchases made by the Creator themselves or related parties to manipulate metrics;
• use of artificial means to inflate sales, relevance, or engagement;
• simulation of consumption or events.

Such practices may result in:

• immediate account suspension;
• full withholding of funds;
• reporting to competent authorities.

The Platform is not liable for:

• losses resulting from User decisions;
• unmet subjective expectations;
• disputes between User and Creator;
• chargebacks filed without basis.

To the fullest extent permitted by law, the Platform's liability is limited to its role as a technological intermediary.

This Policy may be changed at any time. The current version will always be the one published on the Platform.

Continued use after changes implies awareness and agreement.
